By using the Logbook² app you agree to these terms and to our Logbook² Privacy Policy. If you do not agree, do not use the app.
1. What Logbook² is
Logbook² is a pilot logbook app for iPhone, with an Android version to follow. You enter your flights and it keeps your totals, shows recency and expiry information, and produces exports and printable logbook pages.
You must be 18 or older to use Logbook².
2. Important notice about regulations
Logbook² produces logbook pages and summaries formatted to the layout used under SA-CATS 61 (the technical standards to Part 61 of the South African Civil Aviation Regulations).
Logbook² is not approved, endorsed or certified by the South African Civil Aviation Authority (SACAA). No such approval scheme exists for electronic logbooks.
You, the pilot, remain solely responsible for:
- the accuracy, completeness and legal validity of your logbook;
- entering your flights within the time limits in CAR 61.01.8;
- printing and filing your pages at least every 90 days, as that regulation requires;
- keeping any signatures and certifications you need;
- retaining your records for the required period.
Totals, recency and currency figures shown by the app are calculated from what you entered. They are aids only. They are not a determination of legal currency, and you must not rely on them as one.
3. Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Logbook² on devices that you own or control, for your own flying records, under these terms and the rules of the app store you got it from.
4. Acceptable use
You agree not to:
- copy, modify, reverse engineer or decompile the app, except where the law allows it despite this term;
- resell, rent, sublicense or distribute the app;
- use the app to keep false or misleading flight records, or to mislead a regulator, employer, examiner or anyone else;
- use the app in a way that breaks the law or the rights of other people;
- interfere with the app's operation or with the app store's systems.
5. Your data
Your logbook is stored only on your device, as the Privacy Policy explains. We have no access to it. That means:
- we cannot recover your data if you lose your phone, delete the app or reset your device;
- you are responsible for making backups and keeping them safe;
- you own your flight records, and we claim no rights in them.
6. Logbook² Pro (subscription)
Logbook² Pro is an auto-renewing subscription sold through the App Store or Google Play.
- Price. R29.99 per month or R299.99 per year. The price is shown in the app before you confirm. A price may change in future, and the store will notify you of the change in advance, as its rules require.
- Free period. Every new installation gets a 30-day free period with all features. You do not need to subscribe to use the app during it.
- After the free period. Without an active subscription you can no longer add, edit or import flights. You can still view, export, print and back up your existing data, and that stays free. We never hold your data back from you.
- Renewal and cancelling. Your subscription renews automatically at the end of each period until you cancel. Cancel at any time in your store account's subscription settings. Cancelling stops the next renewal, and Pro stays on until the end of the period you have paid for.
- Payment and refunds. Apple or Google takes the payment under its own terms, and we never see your payment details. Refunds are handled by Apple or Google under their policies. Nothing in these terms limits a right you have under the Consumer Protection Act 68 of 2008.
- Restoring. Your subscription belongs to the Apple ID or Google account that bought it. Use Restore Purchases on the Subscription screen to bring it back after a reinstall or on a new phone.
7. Intellectual property
The app, its design, text and software belong to Tsamaya (Pty) Ltd or its licensors and are protected by law. These terms give you the licence in section 3 and nothing more. "Logbook²" and "Tsamaya" are our names. Your flight records are yours.
8. No warranty, except what the law requires
We work hard to make Logbook² accurate and reliable, but software can have faults. To the extent the law allows, the app is provided as it is, without warranties of any kind, including that it is error-free, that it is fit for a particular purpose, or that its calculations are correct for your situation.
Nothing in these terms excludes or limits a right you have under the Consumer Protection Act 68 of 2008 or any other law that cannot lawfully be excluded.
9. Limitation of liability
To the maximum extent permitted by South African law:
- we are not liable for any loss or damage arising from your use of, reliance on, or inability to use the app, including loss of data, a lapsed licence or rating, a failed check, an audit finding, or a decision made on the basis of a total, recency or currency figure;
- where liability cannot be excluded, it is limited to the amount you paid us for the app in the 12 months before the claim arose (for most users, nothing; for a Pro subscriber, what they paid for Pro).
Nothing in these terms limits our liability for loss caused by our gross negligence or wilful misconduct, or any other liability that the law does not allow us to limit.
10. Changes to the app and these terms
We may improve or change the app, and we may update these terms. The version and effective date are at the top of this page. If a change is significant, we will tell you through the app or the app store. If you keep using the app after a change takes effect, you accept the updated terms. If you do not accept them, you can stop using the app and cancel your subscription.
11. Termination
You may stop using the app at any time. Uninstalling deletes the data the app stored on your phone, so export or back up what you need first. Uninstalling does not cancel a subscription: cancel it in your store account.
We may suspend or end your licence if you break these terms. Your right to view, export, print and back up your own data does not depend on a subscription, and we will not use termination to withhold it where we are able to give it to you.
12. Apple App Store and Google Play
If you got Logbook² from the Apple App Store or Google Play, the following also applies.
- These terms are between you and us, not Apple or Google. We, not Apple or Google, are responsible for the app and its content, and for maintaining and supporting it.
- Purchases, billing and refunds are handled by the store under its own terms.
- If the app fails to meet a warranty that applies, you may tell the store, which may refund what you paid for the app, if anything. Apple and Google have no other warranty obligation for it.
- We, not Apple or Google, deal with any claim about the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims.
- Apple and its subsidiaries are third-party beneficiaries of these terms for the App Store version and may enforce them against you.
13. General
South African law governs these terms. If you have a complaint, please contact us first at info@tsamayaapp.co.za and we will try to resolve it. You may also approach the National Consumer Commission, the Information Regulator (for privacy) or a South African court with jurisdiction. If any clause is unenforceable, the remaining clauses continue to apply. These terms and the Privacy Policy are the entire agreement between you and us about the app.
