By using the Tsamaya app you agree to these terms. If you do not agree, do not use the app.
1. What Tsamaya is, and what it is not
Tsamaya is an information tool. It suggests driving routes with lower statistical exposure to areas and roads showing elevated risk in historical, statistical data (public crime statistics, mapping data, and curated review).
Tsamaya is not a safety guarantee, a security service, an emergency service, or a substitute for your own judgement.
2. The risk disclaimer (read this one)
- "Lower-risk" means lower statistical exposure relative to a default route. It does not mean "safe." No route anywhere is free of risk.
- Our data is historical and periodically updated. Conditions change faster than any dataset: incidents occur on roads our data rates well, and routes our data rates poorly may be uneventful.
- Coverage is limited to specific South African metros and is not exhaustive within them. Absence of a marked zone does not mean absence of risk.
- Routing depends on third-party services (mapping, traffic) and device sensors (GPS) that can be wrong, stale, or unavailable.
- You remain solely responsible for where and how you drive: obey road laws, road signs, closures, and official instructions; stay alert; use your own judgement over any suggestion the app makes.
- In an emergency, do not use the app: call the SAPS on 10111 or 112 from a mobile.
3. Acceptable use
Use the app only as a personal navigation aid, lawfully, and without interacting with the screen while driving (use voice guidance and mount the phone). Do not scrape, resell, or redistribute the app's data; commercial or fleet use requires a written agreement with us. Reports and feedback you submit through the app must be honest and must not contain personal information about identifiable people; abusive or defamatory submissions may be ignored or deleted.
4. Intellectual property
The app, its design, brand ("Tsamaya", the mark, "Go well"), and its curated risk dataset are ours or our licensors'. Map data © Mapbox and © OpenStreetMap contributors. Crime statistics derive from public SAPS releases. Fuel prices are the regulated prices published by the Department of Mineral and Petroleum Resources.
5. Availability and changes
The app is provided "as available." Features, coverage areas, and data may change, break, or be withdrawn without notice: this is a beta-stage product. We may suspend the service for maintenance or at our discretion.
6. Tsamaya Premium (optional subscription)
Tsamaya Premium is optional and adds extras for the drive, such as more detailed place search, trip history and a SARS travel logbook, Arrive by, the fuel cost and toll prices of a trip, earlier fuel price alerts and additional vehicle markers. It is sold as an auto-renewing subscription (monthly or annual, and weekly on the App Store) and, on Google Play, also as a 7-day pass that does not renew. Every feature that routes you around risk (all route options, risk alerts, Guardian, reports, CarPlay and Android Auto) stays free and never depends on Premium.
- Where you buy it. Premium is sold through the Apple App Store or Google Play. The store takes the payment under its own terms; we never see your card or bank details.
- Prices and trials. The plans, their prices and any free trial are shown in the app before you confirm. A free trial is offered once per Apple ID or Google account, and you are charged when it ends unless you cancel in time: on the App Store at least 24 hours before it ends, on Google Play before it ends.
- Renewal and cancelling. Subscriptions renew automatically at the end of each period. On the App Store, turn off auto-renew at least 24 hours before the period ends; on Google Play, cancel before the renewal date. Both are done in your store account's subscription settings (the app links to them). Cancelling stops the next renewal; Premium stays on until the end of the period you paid for. The 7-day pass on Google Play does not renew: it ends after 7 days unless you buy another pass, which adds 7 days, so there is nothing to cancel.
- Whose it is. Premium belongs to the Apple ID or Google account that bought it and works on that account's devices on the same platform. It does not carry over between Apple and Android devices. Restore Purchases in the app brings it back after a reinstall or on a new phone.
- Refunds. Refunds are handled by Apple or Google under their refund policies. Nothing in these terms limits a right you have under the Consumer Protection Act or the Electronic Communications and Transactions Act.
- Limits and changes. Premium features rely on third-party services that have daily limits (for example Google search); when a limit is reached the app uses its free alternatives for the rest of that day. We may improve or change Premium's features; if we remove a significant one, we will say so in the app, and you may cancel. A price change for future periods is announced by the store in advance, and where the store requires it you are asked to agree.
- Estimates. Arrive by works out a time to leave from typical traffic for that weekday and time, and fuel cost multiplies a route's length by the fuel use you set and a price a litre: yours if you set one, otherwise the official price for the area the trip starts in, or ends in when it starts outside the areas Tsamaya covers (for diesel, the official wholesale price, which is below what pumps charge). Both are estimates: real traffic, driving and pump prices differ, so allow extra time and check the price at the pump. Toll prices are the official tariffs for the vehicle class you choose (class 1, a light vehicle, unless you change it), without e-tag discounts, for the toll gates on the route as planned; the road you actually take, and the gate's own price, are what count. The SARS logbook lists the distance each recorded drive covered (a guided drive along its route, a drive without a route along its GPS track) and what you enter; it is a record for you to check and complete, not tax advice, and you remain responsible for what you give SARS. Fuel price alerts are sent before a change, usually on the Monday to Premium devices and otherwise at noon the day before, from the official announcement of the new prices; an announcement can be late or corrected, so an alert can be late, missing or wrong, and the price at the pump is what you pay.
6a. One-time purchases
Some extras are sold once, with no subscription: an unlock for using a photo of your own car as the map marker (one photo, two photos, or the second photo when you already have one), and search packs of extra detailed place searches. They are sold through the Apple App Store or Google Play, at the price shown in the app before you confirm, as a single payment that never renews, so there is nothing to cancel.
- Car photo unlocks belong to the Apple ID or Google account that bought them, work on that account's devices on the same platform, and come back with Restore Purchases. Premium includes both photos. If you were already using a photo of your car before the unlock went on sale, you keep one without paying.
- Search packs add detailed searches to the device that bought them. They are used only after that device's daily share, one for each detailed search that Google answers (a search that fails is not counted), and they do not expire. They are kept on that device: Restore Purchases does not bring them back after the app is reinstalled, and they do not move to another device. When Google's daily limit for all of Tsamaya is reached, search uses the free alternatives for the rest of that day, and your pack searches wait for you.
- Refunds are handled by Apple or Google under their refund policies, as for Premium. Nothing in these terms limits a right you have under the Consumer Protection Act or the Electronic Communications and Transactions Act.
7. Limitation of liability
To the maximum extent permitted by South African law (including the Consumer Protection Act, where it applies):
- the app is provided without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of data;
- we are not liable for any loss, damage, injury, or death arising from use of, reliance on, or inability to use the app or its route suggestions, except to the extent such liability cannot lawfully be excluded;
- where liability cannot be excluded, it is limited to the amount you paid us in the preceding 12 months (for most users nothing; for a Premium subscriber, what they paid for Premium).
8. Indemnity
To the extent permitted by law, you indemnify us against claims arising from your unlawful use of the app or your breach of these terms.
9. Termination
You may stop using the app at any time; uninstalling removes all on-device data. Uninstalling does not cancel a Premium subscription: cancel it in your store account (§6). We may suspend access for breach.
10. General
South African law governs these terms. If any clause is unenforceable, the rest survive. These terms plus the Privacy Policy are the whole agreement. We may update these terms; continued use after an in-app notice is acceptance.
Appendix A: short in-app disclaimer (first-run screen)
Tsamaya suggests lower-risk routes using historical crime statistics and curated local knowledge. Lower-risk does not mean safe. No app can guarantee your safety, and conditions change faster than any data. You stay responsible for every driving decision. In an emergency call 10111 or 112.
